General Terms and Conditions of Sale (GTC)

These General Terms and Conditions of Sale (hereinafter referred to as the "GTC") shall apply, without restriction or reservation, to all sales concluded by the enterprise Hugo Fizaine (hereinafter referred to as the "Seller") with consumers and non-professional buyers (hereinafter referred to as the "Customer"), desiring to acquire the products offered for sale on the website www.motodistri.com
The validation of the order by the Customer shall be deemed to constitute full, complete, and unreserved acceptance of these GTC.

Article 3: Product Characteristics and Disclaimers
The Customer is required to refer to the description of each product to ascertain its essential properties and characteristics.
- Aftermarket Products: The Customer is expressly informed that the spare parts sold on the website are "generic or aftermarket" parts and are not original manufacturer (OEM) parts.
- "Racing" Products: Products designated as "racing" are strictly prohibited for use on public roads and are exclusively reserved for use on circuits or private tracks. The Seller declines all liability in the event of unlawful use of these products.
- Sale of Batteries: Pursuant to Regulation (EU) 2019/1148, the sale to private individuals of batteries with a separate acid pack is strictly prohibited. These products shall under no circumstances be sold to non-professional end consumers.
The Customer bears sole responsibility for the selection of products, their compatibility with their vehicle, their installation, and their use.
Article 4: Prices
Prices are expressed in Euros (€) and are inclusive of all taxes (VAT included). They do not include delivery costs, which are billed additionally and indicated prior to order validation. The Seller reserves the right to modify prices at any time, but products shall be invoiced at the rates in effect at the time of order validation.
Article 5: Orders
The order process is as follows: product selection, cart validation, entry of contact details, choice of delivery method, acceptance of the GTC, and payment. Any validated order constitutes a firm and definitive contract of sale.
The Seller reserves the right to cancel or refuse any order from a Customer with whom a dispute exists regarding the payment of a previous order or where there is a suspicion of fraud.
Article 6: Payment
Payment is due immediately upon ordering. Payments are secured by our financial partner STRIPE. In the event of fraudulent use of a bank card, the Seller reserves the right to suspend the shipment of the order.
Article 7: Delivery, Receipt, and Transfer of Risk
Products are delivered to the delivery address indicated by the Customer at the time of ordering. The timeframes announced on the website are provided for informational purposes only.
Obligation of Inspection upon Delivery: The transfer of the risk of loss and damage occurs at the moment the Customer takes physical possession of the products. It is the Customer's responsibility to verify the condition of the packaging and the quantities of the products at the time of delivery.
In the event of damage or a damaged parcel: The Customer must note clear, precise, and detailed reservations on the carrier's delivery slip. In the event of transport-related damage (damage or partial loss), the Customer must send a formal protest to the carrier (with a copy to the Seller) within three (3) days of receipt. Without such reservations, no claim related to transport may be accepted by the Seller.
Article 8: Right of Withdrawal and Returns
In accordance with European legislation, the Customer has a period of fourteen (14) days from the receipt of the product to exercise their right of withdrawal.
- Strict Return Conditions: Products must be returned new, unused, in perfect resale condition, and in their original packaging. Products must show no damage, and the packaging must bear no additional labels (except those of the return carrier) or writing marks. Any product returned incomplete, damaged, soiled, or used shall result in the cancellation of the right of withdrawal. For safety reasons, protective equipment (helmets, etc.) that has been worn on the road shall not be accepted for return.
- Return Costs: Shipping costs related to the return are exclusively and entirely borne by the Customer.
- Procedure: The Customer must first notify the Seller by e-mail at motodistri@gmail.com. The parcel must then be shipped only to the Seller's registered office in Belgium (and under no circumstances to the address of the logistics dispatch platform).
Article 9: Legal Warranties
Products benefit from the legal warranty of conformity (2 years) and the warranty against hidden defects.
Warranty Exclusions: Expressly excluded from any warranty are defects and damage caused by:
- Normal wear and tear or deterioration over time
- Abnormal use of the product, failure to comply with conditions of use, or modification of the product by the Customer
- Lack of maintenance, improper installation, assembly, or negligence by the Customer
- An accident or drop of the product
Article 10: Limitation of Liability
The Seller shall not be held liable for any inconvenience or damage inherent to the use of the Internet (service interruption, external intrusion, computer viruses). In any event, should the Seller's liability be invoked, it shall be strictly limited to the amount of the order for the product that gave rise to the damage.
Article 11: Force Majeure
The performance by the Seller of its obligations shall be suspended in the event of a fortuitous event or force majeure that hinders or delays performance (fire, flood, transport or postal service strikes, pandemics, etc.).
Article 12: Governing Law and Disputes
These GTC are governed by Belgian law. However, in accordance with European regulations, this choice of applicable law does not deprive the consumer residing outside Belgium of the protection afforded by the mandatory provisions of the law of their country of habitual residence.
In the event of a dispute, an amicable solution shall be sought as a priority. Failing agreement, the consumer may, at their choice, in addition to the Belgian courts, seize the court of the place where they are domiciled.
